Filing a DMCA Takedown Notice

To file a copyright infringement notice per 17 U.S.C. § 512(c), your written communication must include ALL of the following:

Physical or Electronic Signature: Your handwritten or digital signature
Identification of Copyrighted Work: Describe the copyrighted work you claim has been infringed (e.g., "My original video titled 'AI Art Tutorial' published on [date]")
Identification of Infringing Material: Specific URL(s) of infringing content on Shaire (e.g., https://frontend-kappa-six-50.vercel.app/video/ABC123)
Your Contact Information: Full name, mailing address, telephone number, and email address
Good Faith Statement: "I have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law"
Accuracy and Authority Statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or authorized to act on behalf of the copyright owner"

Response Timeline

Processing: We respond to valid DMCA notices within 7 business days and remove infringing content promptly upon verification.

Notification: Content creators are notified of takedowns within 24 hours via email.

Counter-Notification Process

If you believe your content was removed in error or misidentification, you may file a counter-notification per 17 U.S.C. § 512(g). Your counter-notification must include ALL of the following:

Your Physical or Electronic Signature
Identification of Removed Content: Description of the content and the URL where it appeared before removal
Your Contact Information: Full name, address, phone number, and email
Good Faith Statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification"
Consent to Jurisdiction: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if outside the United States, the Northern District of California, and I will accept service of process from the person who provided the original DMCA notification"

Timeline: Upon receipt of a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10-14 business days, we will restore the content.

Repeat Infringer Policy

Shaire maintains a policy of terminating user accounts that are repeat copyright infringers in appropriate circumstances. We track copyright infringement notices and may terminate accounts after multiple valid DMCA takedown notices.

Users may appeal termination decisions by demonstrating that the notices were invalid or filed in error.

False Claims and Abuse

Section 512(f) Liability: Anyone who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and attorney fees. Similarly, filing false counter-notifications may result in liability.

Reject notices that do not comply with DMCA requirements
Terminate accounts that abuse the DMCA process
Refer cases of perjury or false claims to appropriate authorities
