2. Copyright Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).

Repeat Infringer Policy: Users who repeatedly infringe copyrights will have their accounts terminated in accordance with our repeat infringer policy.

3. Content Ownership

You retain ownership of your AI-generated content. By uploading, you grant Shaire a license to display, distribute, and process your content for platform operation.

4. User Accounts and Termination

You must provide accurate information for account creation via AWS Cognito. Users must be 13 years or older. Users under 13 require verifiable parental consent per COPPA regulations.

Shaire may suspend or terminate accounts for violations of these Terms. Upon termination, we may delete your content after 30 days, subject to applicable laws and our Privacy Policy.

You may delete your account at any time through your account settings. We will process data deletion requests in accordance with GDPR and CCPA requirements.

5. Prohibited Content and Moderation

Prohibited content includes:

Copyrighted material without permission
Deepfakes without explicit consent
Misleading, deceptive, or false information
Hate speech, harassment, or discriminatory content
Illegal, harmful, or malicious content
Spam, malware, or phishing attempts
Content violating third-party rights (e.g., privacy, publicity, likeness, intellectual property)

Moderation: Shaire may moderate, remove, or restrict content without prior notice. Users may appeal content decisions by contacting contact.shaireai@gmail.com within 30 days. We respond to appeals within 14 days.

6. AI Watermarking

All content receives permanent AI-generated watermarks for compliance and transparency. This cannot be removed or disabled.

7. Platform Rights and Advertising

We reserve the right to remove content that violates these terms or applicable laws. For content moderation appeals, see Section 5.

Advertising: We may display advertisements on the platform. By using Shaire, you consent to tracking and data collection for ad personalization in accordance with our Privacy Policy and Cookie Policy.

Third-Party Services: We use third-party services including AWS (hosting, processing), AWS Cognito (authentication), and advertising partners (Ezoic, PropellerAds). See our Privacy Policy for details on data shared with third parties.

8. Indemnification

Users agree to indemnify and hold harmless Shaire from any claims, damages, or expenses arising from their content, use of the platform, or violation of these Terms.

9. Limitation of Liability

Shaire is not liable for user-generated content. Users are responsible for their uploads and any resulting legal issues. Our liability shall not exceed $100, except for cases involving gross negligence or willful misconduct.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts of San Francisco County, California.

11. Dispute Resolution and Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration under American Arbitration Association (AAA) rules in San Francisco, California. Users waive the right to participate in class action lawsuits.

12. Changes to Terms

We may update these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms. Material changes will be communicated via email or platform notification.
